By accessing our Site or placing an order with SeedsChoice (“you” or “the customer”), you agree to these Terms. Please read them carefully. If you do not agree, do not use our website or services.
United States market presentation: This version displays information relevant to visitors using the United States market, including prices in USD and United States shipping information. SeedsChoice also supplies customers in other countries. Currency, taxes, product availability, shipping rates and delivery estimates may differ by destination and are shown in the applicable market and at checkout. SeedsChoice remains operated by Trizty Shops B.V., a company established in the Netherlands and subject to applicable Dutch and European Union obligations.

Scope & Applicability
These Terms apply to all offers, orders and agreements made through the SeedsChoice website (the “Site”), for consumers and business customers. This version is localized for the United States market, but SeedsChoice also sells and ships to other supported countries. Destination-specific information displayed in the applicable market or at checkout forms part of the order. The seller and contracting party is Trizty Shops B.V. in the Netherlands.
Policies referenced in these Terms, including our Shipping Policy, Return & Refund Policy, and Privacy Policy, form an integral part of these Terms. If a specific policy contains more detailed terms for its subject, those specific terms apply. Nothing in these Terms limits rights that cannot lawfully be limited or excluded.

Accurate information: Use your real name and valid contact, billing and delivery details. You are responsible for your account and activities carried out through it.

Compliance: Ensure that purchasing, importing, possessing, planting and using the ordered seeds is lawful in your location.

Lawful use only: Seeds are sold for legitimate horticultural or collection purposes. Do not use them for unlawful purposes.
If you do not meet these criteria, we may cancel orders, refuse service or close your account where permitted by law.
Product Information & Description
SeedsChoice specializes in high-quality seeds sourced from our own cultivation, certified growers across Europe and reputable markets. Our business is established in the Netherlands, and we seek to comply with the Dutch and European Union requirements applicable to our operations. Product pages describe the varieties and other relevant details as accurately as reasonably possible.

Natural variations: Seeds are biological products. Results vary depending on soil, climate, storage, care and other growing conditions. Images are illustrative.

No guaranteed outcomes: We do not guarantee a specific germination rate, yield, color, size or other growing result unless expressly stated in writing.

Intended use: Products are offered for planting, cultivation or collection and are not sold for immediate consumption. Alternative uses are at your own risk.

United States requirements: Products offered by SeedsChoice may be lawful to trade from the Netherlands and within the European Union while still being subject to United States federal, state or local import and agricultural requirements. You are responsible for checking whether a product may lawfully be imported, possessed, planted or used at the delivery destination.

Inspections and restrictions: United States customs, agricultural authorities or carriers may inspect, delay, refuse, return or otherwise restrict a shipment in accordance with applicable rules. These decisions are outside our direct control.
We may correct obvious errors or typographical mistakes when discovered. Corrections do not change orders that have already been accepted unless required by law or agreed with the customer.
Ordering & Contract Formation

Placing an Order: Add products to your cart, enter the requested shipping, billing and payment information, review the complete order total, and then confirm the order.

Order Confirmation: You will receive an email acknowledgment containing the order details and an order number. The purchase contract is concluded when we dispatch the goods or expressly confirm acceptance. We may cancel an order before dispatch for a lawful reason, including a pricing or description error, suspected fraud, unavailability or an import restriction. Any payment already received for a cancelled order will be refunded.

Payment: Orders must be paid in full before shipping. Payments are subject to authorization by the applicable payment provider.

Pricing Errors: If an obvious pricing or product-information error is discovered before acceptance, we may ask you to reconfirm the order using the corrected information or cancel it for a full refund.

Order Amendments: Contact us promptly if you want to request a change. Changes cannot be guaranteed once processing has begun. After dispatch, the return procedure applies.

Language: The default contract language is English. Any translation is provided for convenience.
Pricing, Taxes & Payment
Prices displayed to visitors using the United States market are shown in United States dollars (USD).
The tax treatment of an order depends on the delivery destination and the order information entered during checkout. Any tax amount calculated for the order, together with the shipping charges, final order total and transaction currency, will be displayed at checkout before payment. The amount displayed at checkout before you submit the order is the amount you agree to pay to SeedsChoice.

Product prices: Product prices are displayed on the applicable product pages and may change without affecting orders that have already been accepted.

Shipping charges: Shipping charges are determined by the destination and total order weight and are displayed at checkout before payment. See our Shipping Policy.

Import charges: Customs duties, import charges, handling charges or carrier fees imposed separately by an authority or carrier may not be included in the checkout total and, where applicable, remain the customer’s responsibility.

Bank or provider charges: Your bank, card issuer or payment provider may apply its own foreign transaction, conversion or processing charges. These charges are not controlled by SeedsChoice.
Payment Methods: Available secure payment methods are shown at checkout and may depend on the customer’s location, device and payment provider. Payment information is processed through trusted payment gateways; SeedsChoice does not store complete card details.
Payment Timing: Payment is due at checkout unless expressly agreed otherwise. Unpaid orders may be cancelled automatically.
Receipts and Invoices: We provide an order confirmation or receipt after successful payment. Any information required for an invoice must be supplied accurately during checkout or promptly after ordering.
Shipping & Delivery

Shipping origin: Orders are shipped from our own warehouse in Meppel, the Netherlands.

International availability: SeedsChoice ships to the United States and other supported countries. Available products, shipping services, rates and delivery estimates may differ by destination and are shown in the applicable market or at checkout.

Processing time: Orders are normally processed within 1–2 business days, Monday through Friday. Orders placed on weekends or Dutch public holidays are processed on the next business day. Processing time is separate from estimated delivery time.

United States delivery: For orders delivered to an address in the United States, the estimated delivery time is 4–10 working days. Delivery estimates are not guaranteed. Estimates for other countries may differ.

Carriers: We primarily use PostNL, DHL and DPD together with their international or local delivery partners. The available service depends on the destination, order weight, package size and selected delivery option.

Free shipping: Standard shipping is free for orders of $35.00 USD or more delivered to an address in the United States.

Orders below $35.00 USD: Shipping is calculated according to total order weight. The exact available rate is displayed at checkout. See our Shipping Policy for the applicable weight ranges and rates.

Tracking: Tracking is provided when it is included with the selected shipping service. Available tracking information will be included in the shipping confirmation email.

Packaging: Products are packed securely for international transport. We will try to accommodate reasonable delivery notes but cannot guarantee that a carrier will follow them.

Customs and agricultural controls: We provide the shipping information and declarations reasonably required from us. Customs or agricultural procedures may cause delays or result in a shipment being refused, returned or restricted. SeedsChoice does not control decisions made by authorities or carriers.

Delivery issues: Contact us if a shipment appears lost or arrives damaged. We may require tracking information, photographs or a reasonable carrier investigation before providing an appropriate replacement or refund.

Partial shipments: We may split an order into more than one shipment at no additional shipping cost to the customer and will provide available shipment information.

Failed delivery: Customers are responsible for providing a complete and accurate address and for arranging collection or redelivery where required. An unclaimed or incorrectly addressed shipment may be returned. Additional reshipping charges may apply.

Risk of loss: For consumer orders, SeedsChoice remains responsible for the goods until delivery except where applicable law provides otherwise. For business orders, risk generally passes when the shipment is handed to the carrier, to the extent permitted by law.
Returns & Cancellations
Customers ordering through the United States market may request an eligible return within 30 days after delivery. Customers ordering through another market should consult the return information displayed for that market. This commercial return period is separate from any mandatory rights that may apply under applicable law.
How to Initiate a Return

Contact us: Email info@seedschoice.com, use our contact form or call us with the order number and the products you want to return. Wait for return instructions before sending the products.

Return destination: Approved returns from the United States must be sent to the return address supplied by our support team in the Netherlands.

Return shipping: Pack the products securely and use an appropriate shipping method. You are responsible for international return shipping costs and for the returned shipment until it is received, unless the return is caused by a damaged or incorrect product or another error by SeedsChoice.

Condition: Returned products must be unused, undamaged and in their original condition. Seed packets and other sealed products must remain unopened unless the product was delivered damaged, defective or incorrect.

Timing: The return request must be made within 30 days after delivery. Send the approved return without unreasonable delay and include the requested order details.

Inspection and refund: After an eligible return has been received and inspected, an approved refund will normally be issued to the original payment method within 5–7 business days. Additional processing time by the customer’s bank or payment provider may apply.

Original shipping charges: Original shipping charges are not refunded unless the return is caused by an error by SeedsChoice or applicable law requires otherwise.
Order cancellation before dispatch: Contact us as soon as possible. We will try to cancel an order that has not yet been dispatched, but cancellation cannot be guaranteed after processing has begun. After dispatch, the return procedure applies.
Exchanges: We do not offer direct exchanges. Return an eligible product for a refund and place a new order.
Damaged, defective or incorrect products: Contact us promptly and provide the order details and requested photographs. If the issue is confirmed, we will provide an appropriate replacement or refund and cover the related shipping costs as required.
Exceptions: Custom or personalized products may be ineligible for return where applicable. Any product-specific exception will be stated before purchase. Products that have been used, opened, altered, damaged after delivery or returned outside the permitted period may be refused or may receive a reduced refund where permitted by law.
Business customers: Consumer return rights may not apply to business purchases. Business returns are handled according to the agreement and circumstances of the order.

Product Quality, Warranties & Disclaimers
Conformity and quality: Products must correspond to their description and meet any mandatory quality requirements that apply to the order. Available remedies may include replacement or refund.

Biological products: Seeds are natural products. Germination and growing results depend on storage, climate, soil, planting method, water, temperature, care and other circumstances outside our control.

No guaranteed growing results: Unless expressly stated in writing, we do not guarantee a particular germination rate, yield, harvest, appearance or other cultivation result.

Implied warranties: Any implied warranties, including merchantability or fitness for a particular purpose, are limited or excluded only to the fullest extent permitted by applicable law.

Quality concerns: Contact us if results indicate a possible product-quality issue. We may request information about storage, sowing and growing conditions so that the matter can be assessed.

No medical or consumption warranty: Seeds are sold for planting, cultivation or collection and not for immediate consumption, medical use or treatment.
Limitation of Liability

Use of products: SeedsChoice is not responsible for unlawful, unintended or improper use of products except where responsibility cannot legally be excluded.

Indirect or consequential loss: To the extent permitted by law, we are not liable for indirect loss, lost income, lost profits, crop losses, data loss or similar consequential damages.

Cap on direct damages: To the extent permitted by law, our aggregate liability relating to a product or order is limited to the amount paid for the affected product or order.

Events outside our control: We are not liable for delay or failure caused by circumstances reasonably outside our control, including natural disasters, strikes, carrier disruption, severe weather, customs procedures or government action.

Website use: The Site is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access.

Information and advice: Guides and growing information are general and do not guarantee a particular result.

Governing Law & Dispute Resolution
Trizty Shops B.V. is established in the Netherlands. These Terms and transactions with SeedsChoice are governed by the laws of the Netherlands, without prejudice to mandatory consumer protections or other rights that cannot lawfully be waived under applicable law.
Resolving concerns: We encourage customers to contact us first so that a complaint or dispute can be addressed directly and, where possible, resolved amicably.
Jurisdiction: Subject to mandatory applicable law, disputes that cannot be resolved amicably will be submitted to the competent courts of the Netherlands.
Limitation period: Claims must be brought within the limitation periods provided by Dutch law or any other mandatory limitation period that applies.
Miscellaneous

Entire agreement: These Terms and the referenced policies constitute the agreement relating to use of the Site and an order.

Severability: If a provision is found invalid or unenforceable, it will be severed or adjusted to the minimum extent required while the remaining provisions continue to apply.
